The tenants created a petition to hold their apartment landlord accountable for the deplorable conditions and sudden eviction notices served on all tenants.
INDIANAPOLIS — Tenants at the Irvington Arms apartments in Irvington say they are fed up with the dire living conditions and are calling on the management company to do the right thing.
“We had dog feces that had been piling up for months,” tenant Dominiaca Hudson said. “Shots were commonplace at five a.m. inside the building.”
Hudson said all tenants received a surprise eviction notice on Oct. 3 forcing them to evacuate.
“I opened my door and taped my and everyone else’s door 10 days notice,” Hudson said.
She said the landlord now wants to evict all tenants whether they are paid up to date or not.
Hudson shared photos of horrific indoor conditions showing shattered glass and trash in the hallways, smashed windows and more.
She said the problems started two years ago when new management took over.
According to the Marion County Assessor’s Office, the land housing the Irvington Arms apartments is owned by Braavosi Holdings LLC c/o David Pezzola.
13News revealed that David Pezzola is also listed as owner and CEO of Icarus Investment Group.
The management company for Irvington Arms Apartments is listed as Chicago-based Atlas Asset Management.

The Marion County Health Department sent a letter to Braavosi Holdings LLC on October 5 stating that a re-inspection was performed on the property and revealed “remaining conditions which are in violation of Chapter 10 of the Health Code and Hospital Corporation of Marion County, Indiana.”
The MCPHD instructed Pezzola to correct numerous violations, such as removing trash from the hallways, fixing cracks in the ceilings, and making sure doors close properly.
A health department spokesperson told 13News that officials plan to “file the violations in court after the Oct. 17 reinspection, unless the property is released or compliant.”

Hudson said the eviction notice received by tenants also said anyone who was not out of the property by Oct. 10 would be evicted by WISP.
“IMPD confirms that we are working with the current owners of this particular property. However, we will only take action if we have an emergency evacuation order, and that comes from the Marion County Health Department and any action taken civilly will be enforced by the township constable,” IMPD Constable William Young said.
On Friday, 13News saw a few tenants moving their belongings out of the building.
Lauren Hall Bushman helped start a petition against the owner of the apartment.
“When I saw the gravity of the situation and how dangerous it was for everyone in the community that this building was allowed to exist in this way, it is simply not humane. We are calling on the city to hold him accountable for displacing countless people,” Hall Bushman said.
Hudson later learned that Hall Bushman had become involved in the petition.
“She contacted me for help and advice to get the attention of the municipal authorities, as she had made several attempts to do so, in addition to contacting the management companies who had been overseeing the building without a callback for nearly a year,” says Hall Bushman.
Hudson continued to call for help after the power went out on the third floor.
“I just had a feeling something bad was going to happen. I got the notice on October 3rd and woke up on October 4th, my birthday, and there was a homicide in the hallway,” Hudson said.
The victim has been identified as Deandre Halbert, 35.
“Nobody could have known he was up there. There was no electricity. It was dark,” Hudson said.
“Our hope is that in the petition people will not be evicted. Our hope is that Mr. Pezzola will make the necessary repairs to make this building livable,” Hall Bushman said.
Hudson said tenants feel invisible and unheard.
“It makes you feel like you’re not a human being. It makes you feel like you’re invisible, like you don’t have rights and maybe it won’t happen to a property. middle class,” Hudson said.
